Franco is right. A friend of mine used to be in the IRS think tank (before going solo with estates and trusts law). He said the language in the 501(c)(4) statute was that these groups had to be primarily for promoting social welfare. "Primarily" being the operative word and the loophole for hundreds of Tea Party groups to use to gain this tax-free status.
Since the fracas, the statute has been changed: "To be tax-exempt as a social welfare organization described in Internal Revenue Code (IRC) section 501(c)(4), an organization must not be organized for profit and must be operated exclusively to promote social welfare. "
The fracas started because of the tsunami of applications from hundreds of local/regional Tea Party and ultra-conservative political groups (formed in a backlash against Obama taking office) applying for a 501(c)(4) far exceeded applications from liberal and Democratic groups in 2009 and 2010.
None of these groups were denied their 501(c)(4). But they did become scrutinized prior to receiving their status due to the obvious political nature of their groups.
So the IRS apologized for the inconvenience.
