Second, at September 17, 1939 Polish state already ceased its existence. You can't commit an aggression against non-existed entirety.
Third, territories, taken under protection by Red Army, and then joined to Russia, were not "eastern parts of Poland", those were "western regions of Ukraine and Belarus" previously illegally occupied by Poland.
