Under federal law, employers and universities cannot legally mandate COVID vaccines because they are unlicensed Emergency Use Authorization products which are, by definition, experimental.
With more than 100 U.S. colleges mandating COVID vaccines for in-person attendance and schools enforcing mask mandates, it’s critical people understand their rights.
The bottom line is this: mandating products authorized for Emergency Use Authorization status (EUA) violates federal law as detailed in the following legal notifications.
All COVID vaccines, COVID PCR and antigen tests, and masks are merely EUA-authorized, not approved or licensed, by the federal government. Long-term safety and efficacy have not been proven.
EUA products are by definition experimental, which requires people be given the right to refuse them. Under the Nuremberg Code, the foundation of ethical medicine, no one may be coerced to participate in a medical experiment. Consent of the individual is “absolutely essential.”
Earlier this year, Mary Holland, Children’s Health Defense president and general counsel, and attorney Greg Glaser stated that federal law prohibits employers from mandating EUA COVID vaccines (or EUA COVID-19 tests or masks).
Holland and Glaser wrote:
“If a vaccine has been issued EUA by the FDA, it is not fully licensed and must be voluntary. A private party, such as an employer, school or hospital cannot circumvent the EUA law, which prohibits mandates. Indeed, the EUA law preventing mandates is so explicit that there is only one precedent case regarding an attempt to mandate an EUA vaccine.”
What to do if your school or employer says you must get the COVID vaccine
The Children’s Health Defense legal team has written three legal notifications that anyone faced with a COVID vaccine, COVID test or mask mandate can use to inform employers and universities that they are violating federal law. You can download the three notifications here.
All of the notifications include this language:
“Federal law, Title 21 U.S.C. § 360bbb-3(e)(1)(A)(ii)(I-III) of the Federal Food, Drug, and Cosmetic Act, states the following about products granted emergency authorization usage:
Individuals to whom the product is administered are informed—
(I) that the Secretary has authorized the emergency use of the product;
(II) of the significant known and potential benefits and risks of such use, and of the extent to which such benefits and risks are unknown; and
(III) of the option to accept or refuse administration of the product, of the consequences, if any, of refusing administration of the product, and of the alternatives to the product that are available and of their benefits and risks.
Any entity or organization that requires EUA COVID-19 vaccinations, COVID-19 tests or masks are in violation of federal law, and will likely face lawsuits if they don’t allow exemptions or alternatives.”
Submitting the notices prepared by Children’s Health Defense is the first step prior to seeking an exemption or taking legal action.
Vaccine exemption laws vary by state. Go to the National Vaccine Information Center to learn more about your state exemptions.

In France they are not going to take it sitting down. They aren't here either but the jab pushers would like you to think everyone is just willingly going to submit to having their blood tainted.

UPDATE:
Here in France it has gone to the extreme with the "Health" Pass. Last week on the 21st ALL restaurants, bars, coffee shops, and any leisure activities like sporting events, theaters, cinemas, museums, were closed to anyone without "the pass" and all staff at these places are mandated to get the jab to keep their job.
It is now a 6 Month prison sentence if you are caught inside any of these places without the pass (the man who slapped the president in the face got only 3 months prison time). Business owners will get a fine of 45,000 euros and 1 year prison sentence if they do not comply with the use of "the pass" and force all their employees to get the jab. (If you know France, you can commit murder and have less of a sentence)
So the result? All the low paid employees quit, they can make more on welfare here. (for now) We can still technically "get take out food" but I just tried last night and every restaurant in our town (that is dine in with take out) has closed their doors due to the lack of staff.
As of last week ALL doctors, nurses and health industry workers have been mandated to get the jab or lose their license, practice, job, business etc. (ALL health care here is Govt paid positions and there are no private health care Doctors or Hospitals etc.)
Since the Health care system is state run and funded, it has been run into the ground. All the good doctors left France 5 Years ago, all the hospitals look like they are 3rd world hospitals since there is no money to repair them, half of the equipment doesnt work and not every hospital is stocked with supplies needed for daily needs (masks, gels, disposable gowns etc).
For 5 years Nurses have been understaffed and doing double the work because the Health care system is nearly bankrupt.... So add to this the mandatory jab.
So the result? Well they took to the streets by the millions and now all the hospitals just lost another 50% of staff capacity. My doctor just went into early retirement (a.k.a. he quit) and I have yet to find a replacement.
As of Aug 1st ALL large malls, retail stores and grocery store owners and their staff need to be jabbed and the health pass is required to enter for employees and customers. This would be the equivalent to closing ALL Targets, Walmarts, Costcos, Home Depots, and all major grocery stores. (basically any building over 20,000 square meters) to those without "the pass".
Result.?? Aug 15th Truckers will be going on strike nation wide; Blocking all access roads in and out of Paris.
Yesterday an entire airport in Northern France closed due to the majority of staff quitting.
As of Sept 15th All public areas and access will be off limits. No farmers markets, no parks, no national parks, lakes, rivers, beaches, recreation areas, campsites etc. and no gathering over 100 people, no churches, no weddings, etc.
As of Oct 1st ALL small vendors such as, delis, pizza trucks, sandwich shops, butchers, bakers, vegetable stands etc.
So as of Oct 1st I will only be able to purchase food by internet and pick up (if allowed).
Food shortages, Truckers strike, hospitals and airports shutting down unemployment going through the roof. Its going to be a bumpy ride folks.
Is it me or does all this seem a bit extreme for a "pass" that isn't exactly working?

It is still only approved as an experimental jab. You seem to want to gloss over that as you push your crap.

Indiana University is pushing this all the way up to the Supreme Court. Given that the CDC Director herself said the vaccines do not prevent transmission, that they are performing worse over time, and the age groups of college students are not vulnerable, I do not know why on earth college students would be mandated to take these.

This is a Moral Panic and nothing more. That's why. Because it's wholly irrational.

It is still only approved as an experimental jab. You seem to want to gloss over that as you push your crap.
Can you cite a Federal court ruling overturning a private employer’s vaccination as a condition of employment?

Absent such a citation, vaccination as a condition of employment is legal.

In addition:

“Federal law does not prohibit public agencies and private businesses from requiring COVID-19 vaccines that are under emergency use authorization, the Department of Justice concluded in an opinion.”


This means that Justice won’t be bringing suit against employers’ policies of vaccination as a condition of employment.
 
Indiana University is pushing this all the way up to the Supreme Court. This is a Moral Panic and nothing more. That's why. Because it's wholly irrational.
Congress enacts laws; the Executive Branch interprets those laws for the purpose of administration; and the Federal courts determine what the law means and if the administration of laws is appropriate.

Currently vaccination as a condition of employment comports with Federal law, as determined by the Justice Department (Executive Branch) and Federal courts (Judicial Branch).

I know it is sickening. We should be able to get rid of these bought and paid for judges.

On that note I found this good little tidbit. Jabs are just for the masses not for the elites.

The majority in Israel are vaccinated,be grateful you don’t live there.As hard as it is to believe they got it even worse there than in Australia.In Israel they throw the people thst resist the vaccines in concentration camps.Australia is close to thst but not quite.

America’s frontline doctors also on their site posts some information that you can sue your company if they fire you fir not taking the vaccine cause it also violates the Nuremberg code.

That’s why all that information you posted has me worried about Dalia if she’s okay or been forced to take the vaccine.the truckers going on strike accomplishes nothing but aiding the elite because the only people they are cutting the food off to is the citizens,the elite and criminal politicians will still have access,waste of time I’m afraid.

It also violates religious liberty of many. My mom never subjected us to vaccines. My grandparents lived to the fullness of 89, 99 and 98; with the exception of one who was hit by a speeding car when he was 76 they all lived long healthy lives.

I would never intentionally desire or knowingly allow want to have any ones blood tainted with the vaccine crap as I fervently believe it is wrong in every sense of my the Spirit God put in me. Mixing of animals pieces and parts and aborted babies injecting it into people is an abomination.
