If people named "John Smith" made up 1% of the population, but committed 50% of the crime, would you consider it to be discrimination if they made up 50% of the prison population?

My answer is no.

What's your answer?
 
One would need context. If Joe Smith wasn't being charged for the same or similar crimes or similar sentences I would question everything.
 
Morons make up 30% of Americans, 75% of this board, and 100% of this thread.
