Indeed. A criminal born an American is different than a criminal born elsewhere who breaks the law to enter and continue his criminal spree in another country.

One by birthright is legally allowed in the U.S, even if he commits a crime. The other is illegally in the country and by enforcement of the border laws should have been prevented from entering.
