I reject the very premise of this thread.

Are there some topics which the First Amendment was never intended to cover? Of course. But saying disrespectful things about even an assassinated good man is not on that list.

Can we find such speech disgraceful and loathsome? Yes.

Are we, on that basis, allowed to deny the speaker of such vile things the right to speak them? No.

I believe there has to be some specificity to it, a person or group has to be named and a specific action taken in a threat. An ambiguous threat isn't actionable in a court of law. That's what I think anyway.

I was once told this by law enforcement.

If someone calls you and threatens to punch you, that is not an actionable threat as they can not punch you over the phone.

If someone continues to do so, that is harassment and actionable.

If you are their front porch and threaten them, that is an actionable threat.
