I can’t find the legal basis for Obama’s US Digital Services. Anyone out there able to?

Contrary to the alarmist notions of some folks, Trump validly used an existing federal entity to form the foundation of DOGE. He spelled it out quite clearly in the Exeuctive Order which did the renaming and spelled out its basis.

The former federal entity was US Digital Services. My digging led me to discovering that Obama announced that entity on August 11, 2014. But the can’t find its legal basis.

I can find no such Obama Executive Order. I see no Obama Presidential Proclamation. I can find no statement of any authority or legal basis in any Obama Presidential Memorandum.

I have not (again) reviewed all of Obama’s sought “affordable care Act,” but I have read that the US Digital Service was somehow a part of “Obamacare.”

My question is this: can anybody find the actual legal basis supposedly used by Obama to create US Digital Services?

By the way. Just to be clear, it may not be an unsolvable mystery, but it is a real puzzle. So, if anyone can sleuth it out, I’d like to review it.

The Executive Office, as in the literal legislative item Congress funds. Not a generic catch all for items in the executive branch. The funding is fully discretionary.

When Obama decided that he wanted to tell the world that he had “created” the U.S. Digital Service, he did just that. He said he had created it. Ok.

Other than “saying” it, did he sign ANY document whatsoever in “creating” it?

He wouldn't need to. It's simply a part of the Executive Office, which is an entity belonging solely to the president to be used at his discretion and kept or discarded by his successors. It's more akin to the White House Staff, up to the president's discretion as who is part and what role they play.

Nope. He either did write an EO (or proclamation ode Memorandum) or he didn’t.

If he didn’t, he didn’t.

I would like to see it, if it exists.

In any event, the legality and Constitutionality of Trump’s creation of the DOGE is now pretty clear.

No, he would not need to write an executive order or memorandum. The president doesn't do that for his personal chef or trainer, this is the same thing only pertaining to the unique entity of Executive Office.

There is no doubt that DOGE is fully Constitutional, it is merely an extension of an existing group created by a previous president.

Maobama created it under the executive office of the president, they worked directly for him. Of course congress had to provide additional funding to the executive office of the president to pay the people.

Trump did for separate reasons, he is giving them duties outside of the Executive Office. I'm certainly no fan of Obama, but I can see no fault in his actions in creating USDS.

If you still harbor doubts perhaps the National Archives might be the place to look.
