I live in a retirement community. It probably one of the safest community in America. Though we are only 35 miles from the Mexican border, we have virtually no crime EXCEPT domestic violence. I serve on the Sheriff's Auxiliary, and our biggest problem is dealing with people abusing their spouses, usually due to alcohol, or dementia. On average, our local court issues restraining orders at the rate of 11 per month. NONE of these people have been put on any list that would make them fail a background check, until, or unless they are convicted of a felony, which is not likely to happen to someone who is behaving badly due to dementia. These people are old, white people, and they are armed to the teeth. Deputies fear domestic violence calls more than anything else, because of the danger involved. It is bad enough that most of the people have guns, but it is even worse that if the abused spouse hides, or removes one gun, the perp can go out and buy another one.
Are the DV Offenders not placed on Probation? Here, a misdemeanor conviction for DV results in 30 days in jail, three years formal probation, No contact with the vicitm, No guns, search and seizure, one year anger management (once per week), no alcohol or drugs, testing for AOD, and in the unit of PO's funded by the DOJ grant I managed, 4 face to face contacts each month, one at the offender's residence.
One miss, one dirty test, one violation of an order of probation, one missed class and the offender is taken into custody on a PV and can face up to one year in jail and then need to do over the Anger management class and not get credit for time served off of his 3 year grant of probation.
