The bar for fear of physical harm is not high. That's why cops are basically required to ask "do you want to press charges" any time they even hear about physical contact. It's not because they are eager to do a lot of needless paper work.
The man comes out and he physically handles him without consent. That is easily physical assault. Now, that doesn't mean a prosecutor would prosecute. It means that that man put himself in legal jeopardy by committing physical assault though.
