Here's the problem with that statement

In theory, the DOJ can try yet again, with another grand jury to secure an indictment. Such "grand jury shopping" is generally frowned upon and would amplify existing irregularities in the prosecution of this case, strengthening arguments for dismissal based on vindictive/selective prosecution.

The lapsing of the statute of limitations is not something that can be "overcome" no matter what type of army you think trump has with very few exceptions. And as far as I can tell none of those exceptions apply to this or the Comey case.

Not just that, but while the prosecutor may have immunity for prosecutorial harassment, everyone else participating in this does not.
