Furthermore, the criminal charges require willful intent. You would not and could not prove both that Biden remembered the docs were there between 2017 and 2021 and that he also willfully retained them. In fact, you couldn't even prove he possessed them, during that time period.

And there is the fact that he gave them up immediately, when asked. Good luck convincing a jury he had criminal intent to retain them and hide them, when he cooperated and gave them up immediately.

The gov visited MAL that spring, reviewed what he had, and then just asked him to provide an additional lock on where they were kept, which he did.
That was pending the subpoena they issued to Trump and his lawyers, to turn the classified documents over to the National Archives, which they only partially did, while Trump had his lawyers sign off, saying there were no more classified documents at Mar-a-lago.

Which was a lie of course.

Knowing Trump was willfully retaining classified documents. They got a search warrant to find and seize them.

Which is why they found all those classified documents, that Trump claimed he turned over.
