Facebook and Twitter's censorship of the NY Post Article about Biden breaks something that can't be fixed

You need to do more research then get back to us.

Research the LEGAL ramifications of being a platform versus a publisher. These companies say they are a PLATFORM...therefore they cannot legally censor. If they are a publisher, they can censor, but they can be sued for content.

Think of Verizon’s cellphone network versus the New York Times.

The issue is way more complex than you think.



  • I'm immune from liability for what is said in our comments.
  • A newspaper is immune from liability for its comments.
  • Yelp and similar sites are immune from liability for business reviews that users post.
  • Twitter, Facebook, and YouTube (which is owned by Google) are immune from liability for what their users post.
  • Google is generally immune from liability for its search engine results.
And that's true whether or not the Internet platform or speaker chooses to block or remove certain third-party materials.

US 230 extends protection as it is written.

That is the truth.

Just because you don't like it doesn't mean I don't understand or haven't read about the statute.

You can argue to change the law but until that law is changed Facebook et al are granted platform protection.

And unlike you I don't think Facebook is anything but a seller of advertising space which offers a free messaging service to people dumb enough to subject themselves to that advertising and every single person who signs up for that free messaging service agrees to the terms of service

Social media platforms have become the free speech police and they are using their own interpretation of the 1996 Communications Decency Act, Section 230 to get away with it. Section 230 is a legal provision that essentially protects companies that host user-created content from lawsuits over posts on their services. So what's the problem? Most of the problems around Section 230 involve which posts social networks allow to stand and which ones they remove and the motivations for removal of content. The FCC has the legal authority (not social media companies) to interpret the 230 law and right now there's serious concerns" about how the protections, which essentially give immunity to social media companies, have been interpreted.
