Perhaps some clarification would help here...................Stand Your Ground: No duty to retreat from the situation before resorting to deadly force; not limited to your home, place of work, etc. Castle Doctrine: No duty to retreat before using deadly force if you are in your home or yard (some states include a place of work and occupied vehicles)

I was indicating just last night in a thread regarding the killing of Ahmud Abery in Georgia that Texas is the only state that I'm aware of that allows shooting someone to protect property and then only under a very specific set of circumstances.

Again we find that the shooter in this case originally claimed to have acted in a manner which is contrary to what the law allows. Thank God for that documentation which is as I understand it, heard in the 911 call.

By the way, the attorney representing the family of the 17 year old is the same attorney who represented George Zimmerman in his criminal trial

Evidence at the scene shows Green tried to break into one of the homeowner's vehicles, Smith said.

The homeowner wasn't arrested because he was justified in using deadly force when Green allegedly engaged in a "forcible felony," said Assistant State Attorney Dan Faggard with the 18th Judicial Circuit.

The homeowner told police he feared for his life and for the lives of his wife and baby, Faggard said. Authorities have not publicly identified the homeowner.

Under Florida law, a person can use deadly force if she or he "believes that such conduct is necessary to prevent the imminent commission of a forcible felony."

The person using deadly force "does not have a duty to retreat and has the right to stand his or her ground if the person using or threatening to use the deadly force is not engaged in a criminal activity and is in a place where he or she has a right to be," the law states.

O'Mara contested the prosecutor's claim, saying the homeowner says in the 911 call that he fired his weapon to scare Green off of his property.

"They weren't shooting in fear of personal safety," O'Mara told CNN. "In this case, it's pretty clear, in my opinion, you aren't allowed to shoot someone because they are breaking into your car."

The investigation is ongoing, State Attorney Phil Archer's office said in a statement, and once a final determination is made it will be announced publicly.

Florida's stand your ground law was a topic of debate in the Zimmerman case, as well as in the cases of Michael Dunn, who killed Jordan Davis, 17, during a 2012 argument over loud music in Jacksonville, and Michael Drejka, who killed Markeis McGlockton after McGlockton pushed him in a 2018 confrontation over a handicapped parking space in Clearwater.

Exactly...........for way too many young blacks stealing is sort of a cottage industry....they start off shoplifting usually....then get into selling drugs, burglaries, robbery and armed robbery....thus by the time they get out of H.S. many of them have rap sheets that are quite long....thus rendered unemployable in many cases they turn into career criminals...and our jails are overwhelmed by them.

Exactly...and we must remember also Z was a watchman...though any citizen has the right to follow a suspect and call the police and that is all Z did....what confused a lot of folks was when Z was assaulted by Trayvon they did not understand Z had a absolute right to use lethal force to defend his life...which he did, and the jury agreed...yet here we are all these years later and the usual suspects keep dredging this case up and trying to argue that Z was guilty of murder....they think this way mainly because they are ignorant of the law, ignorant of the facts of the case and buy into the msm propaganda.

Well, the shooter could have been doing both. Say if his vehicle was parked at work and the kid tried to steal it and the owner shot him....then he was clearly just defending his property....however his vehicle was parked at home and he saw the guy breaking or trying to break into it or whatever but since it was in his drive way it is not unreasonable to think the homeowner feared he might also try to break into his house....thus he was not only protecting his property but his family also....now it is quite easy for someone not in his position to play monday morning quarterback and blame him for what he did...but in such a situation first of all fear sets in....a criminal on your property...that would instill intense fear in anyone with children and a wife....and in such a state it is not so easy to always make a good or even rational decision....the first thing that comes into ones mind and very reasonably so...strike back...neutralize the criminal before he has a chance to harm my property, my family or me....and I am sure the age of the suspect never entered his mind.

George Zimmerman shouldn't have approached Trayvon during his watch. He should have just called the police and kept a certain distance away.
But Trayvon was beating him up in order for Zimmerman to be dripping blood from his head.
But it wasn't behind racism.
Zimmerman looks like one of those nerdy security guards that no one takes seriously.

The larger problem we as a society are dealing with is the fact that blacks committ crimes at a disproportionate rate.

Even obama admitted that ....if you deny it I will post it .......any how do you understand what 'dis-proportionate' means when it comes to the rate of black crime?

That's the wrong larger problem. It's not that black skin makes someone more prone to committing crime; it's not genetic. The problem is that the Democrats, mostly starting with Lyndon Baines Johnson, have worked to destroy the black families and to teach them to not be responsible for their own actions. The left has continued the process by decriminalizing crime and teaching minorities that there are no consequences - until there are consequences. The goal is to justify the expansion of the police state, build dependency on the government, ensure that there are plenty of gun crimes to support gun control while not actually punishing the crimes in the disposable communities.

The underlying problem that causes inner city poor, coincidentally black, crime is poverty created by broken homes, out-of-wedlock child birth, the welfare state, weak enforcement of crime so that they can ruin a person's future without actually imprisoning him, and so on - all of this being the agenda and intentional acts of the left and Democrats, including the self-enriching leadership of the black communities.

You've hit much of the difference between the case of Trayvon Martin versus the case of the McMichael's shooting the Arbery kid. Zimmerman carried his gun and had it because he regularly carried it. He didn't instigate the contact; he just followed. He didn't pull his gun until after he was attacked.

The McMichael's specifically went into their house to get their guns with the intent of confrontation. They initiated the contact. They drew their guns on Arbery before Arbery made any threat to them.

The cases have virtually zero similarity.
 
New story from the prosecutor "he was there for water". That's why he had to run and not stop... because water... Was there even water there? The prosecutor is also going with the completely overblown narrative the two were racists wanting to shoot random black men, which is beyond absurd.

The defense states they have a other clip of the incident

I REALLY hate thieves! When caught in the act of stealing, the public should be able to kill them. You work all day at jobs that pay nominal or fair wages, so that you can earn enough in savings to own some personal property and provide for your family, only to have some low-life scum come along and take your hard-earned property away from you. The punishment of death when caught in the act of committing their crimes is adequate, as far as I'm concerned.

Officers found Green unresponsive on a road near the home, police say. They performed CPR, but Green died at the hospital from "an apparent single gunshot wound to his back," Sanford Police Chief Cecil Smith said at a news conference.

The homeowner wasn't arrested because he was justified in using deadly force when Green allegedly engaged in a "forcible felony," said Assistant State Attorney Dan Faggard with the 18th Judicial Circuit.

The homeowner told police he feared for his life and for the lives of his wife and baby, Faggard said. Authorities have not publicly identified the homeowner.

Under Florida law, a person can use deadly force if she or he "believes that such conduct is necessary to prevent the imminent commission of a forcible felony."

The person using deadly force "does not have a duty to retreat and has the right to stand his or her ground if the person using or threatening to use the deadly force is not engaged in a criminal activity and is in a place where he or she has a right to be," the law states.

O'Mara contested the prosecutor's claim, saying the homeowner says in the 911 call that he fired his weapon to scare Green off of his property.

"They weren't shooting in fear of personal safety," O'Mara told CNN. "In this case, it's pretty clear, in my opinion, you aren't allowed to shoot someone because they are breaking into your car."

The investigation is ongoing, State Attorney Phil Archer's office said in a statement, and once a final determination is made it will be announced publicly.

Florida's stand your ground law was a topic of debate in the Zimmerman case, as well as in the cases of Michael Dunn, who killed Jordan Davis, 17, during a 2012 argument over loud music in Jacksonville, and Michael Drejka, who killed Markeis McGlockton after McGlockton pushed him in a 2018 confrontation over a handicapped parking space in Clearwater.

Like Zimmerman, Dunn forewent a stand your ground defense and argued the shooting was in self-defense. Dunn was convicted of murder, Drejka of manslaughter. Both are in prison.

I REALLY hate thieves! When caught in the of stealing, the public should be able to kill them. You work all day at jobs that pay nominal or fair wages, so that you can earn enough in savings to own some personal property and provide for your family, only to have some low-life scum come along and take your hard-earned property away from you. The punishment of death when caught in the act of committing their crimes is adequate, as far as I'm concerned.

Exactly....we need to have public hangings....instead of incarcerating all these criminals at a tremendous expense.....and not even to mention the girl you are replying to is a muslim....and we all know what muslims do to theieves.....she must have little knowledge of her religion. hehheh

 
I was indicating just last night in a thread regarding the killing of Ahmud Abery in Georgia that Texas is the only state that I'm aware of that allows shooting someone to protect property and then only under a very specific set of circumstances.

Again we find that the shooter in this case originally claimed to have acted in a manner which is contrary to what the law allows. Thank God for that documentation which is as I understand it, heard in the 911 call.

By the way, the attorney representing the family of the 17 year old is the same attorney who represented George Zimmerman in his criminal trial

If don't disagree with your sentiments however if the law allowed for shooting someone caught in the act, you know there would be people who would use that as an excuse or justification to shoot & kill someone particularly when there are no witnesses to dispute their story.

Then there is the whole due process thingy of the Constitution but I hear ya.

I was doing some reading on the group and I saw a report that your grand-father perished at the Tuskegge air strip....but there were no details about that.

Would you care to comment on what happened?

I also saw where he was awarded the Distinguished Flying Cross for a straffing run he did over Germany.....very impressive fellow.
