Actually in a civil trial both sides get discovery so they can gather evidence to present to the jury.

If the case is not dismissed then the case moves to the discovery phase where BOTH sides have access to court mandated "discovery" which means deposing witnesses, document production, etc.

The respondents "discovery" isn't written by the plaintiff.

This is not a criminal case you are confusing the two....

But the defense in a law suit does not write the discovery... the plaintiff does.... unless there is a counter suit....
