A Las Vegas casino is facing a lawsuit from a California customer. The gambler wants $500,000 back. He claims the casino was responsible for a drunken blackout. His lawyer claims he was so intoxicated he couldn't read his playing cards.

The gambler, Mark Johnston, recently shared why he believes the casino should lose this hand. Johnston told CBS News' Bill Whitaker, "I mean, picture this: You're walking down the street - you're drunk, you're drunk - and somebody leans over and reaches in your pocket and steals your wallet. Do you think that's right?"

Whitaker asked, "That's what you think they did to you?"

"Yes," Johnston said.

perhaps gambling really is a tax on the stupid....i like to go to casinos....i tuck a few bucks in my jeans and go..i normally take id and cash....no credit cards that limits my losing to the casino

Well, I know if you ever get really ill, Vegas or Tahoe is the place to be. Even their poor hospitals treat you like a king or queen because they get all that revenue from gambling. I know they treated me like royalty when I had that tubal pregnancy. Flew me in a helicopter from Incline Village to Reno...even tipped the heli while I was strapped on the gurney cuz they wanted me to see the lights from way above. I was all drugged up but I remember it. Oh yes..they treated me mighty fine.

I love chasing the sevens once in a while (just slots for me). I take enough to have fun but not enough to hurt too much when I lose. And I say "when" because you have to know what the odds are. And if at some point I'm up enough for it to be satisfying I love to walk out a winner. I know guys that just can't walk out until the pockets are empty and the card maxed out. That's no fun.

i was trying to bet on some football games in england and found that my cards will not allow any charges to any casinos or bookies....lol....i was taken back by this moral stance...they simply said...no gambling with our funds

and this is why there are atms in the lobbies of casinos to get around the block on the credit cards being used at casinos

Wow, either he works for NASA or is a very successful politician. :) ...Why dya think the drinks are free brainiac?

so a gambler starts drinking, knowing it will mess with his judgment, keeps drinking knowing it will only get worse, then blames the casino cuz he lost, like he's never lost at a casino before.

ahhh, lawyers, there's money to be had everywhere.

Did you know there's a lawyer that sues buildings if they don't have more womens bathrooms than mens? He makes a living doing it and teaches at Harvard law.

What an asshole.

If this makes if before a judge they attorneys for the casino should just ask him if he would have kept the money had he won, or would he have given it back since he shouldn't have been gambling.

Reminded me of the McDonald's hot coffee lawsuit years back. Some dork gets burned and sues McDonald's for serving hot coffee. :)

Obviously, you have been tragically underinformed about that event, Delta.

Stella Liebeck who had suffered third-degree burns in her pelvic region when she accidentally spilled hot coffee in her lap after purchasing it from a McDonald's restaurant. Liebeck was hospitalized for eight days while she underwent skin grafting, followed by two years of medical treatment.

Third degree burn --- a severe burn characterized by destruction of the skin through its deeper layers and possibly into underlying tissues, loss of fluid, and sometimes shock.

Yep, the coffee was very hot. Seems like an even better reason to not put it between your legs. I can't say the idea ever occured to me. Some people may want their coffee that hot, I know a gal that always orders it extra hot so I'm sure there are others. We are dumbing our culture down to the lowest common denominator with lawsuits and protections from lawsuits.

o delta and here i thought you knew things:

McDonald’s operations manual required the franchisee to hold its coffee at 180 to 190 degrees Fahrenheit.

Coffee at that temperature, if spilled, causes third-degree burns in three to seven seconds.

The chairman of the department of mechanical engineering and biomechanical engineering at the University of Texas testified that this risk of harm is unacceptable, as did a widely recognized expert on burns, the editor-in-chief of the Journal of Burn Care and Rehabilitation, the leading scholarly publication in the specialty.

McDonald’s admitted it had known about the risk of serious burns from its scalding hot coffee for more than 10 years. The risk had repeatedly been brought to its attention through numerous other claims and suits.

An expert witness for the company testified that the number of burns was insignificant compared to the billions of cups of coffee the company served each year.

At least one juror later told the Wall Street Journal she thought the company wasn’t taking the injuries seriously. To the corporate restaurant giant those 700 injury cases caused by hot coffee seemed relatively rare compared to the millions of cups of coffee served. But, the juror noted, “there was a person behind every number and I don’t think the corporation was attaching enough importance to that.”

McDonald’s quality assurance manager testified that McDonald’s coffee, at the temperature at which it was poured into Styrofoam cups, was not fit for consumption because it would burn the mouth and throat.

McDonald’s admitted at trial that consumers were unaware of the extent of the risk of serious burns from spilled coffee served at McDonald’s then-required temperature.

McDonald’s admitted it did not warn customers of the nature and extent of this risk and could offer no explanation as to why it did not.

180 to 190 degrees is a wee more than hot

Yep. That's why I said very hot. And that some people want it that way. If you're going to drink coffee in a car while driving you should use a cup made for it. Lots of folks managed to drink McDs coffee without maiming themselves and if it was too hot for some, vote with your money.

if you read the link you would see there have been 700 plus lawsuits over this and mickeyd's had been warned again and again to lower the temperature of their coffee

Warned by whom? The Department of Coffee Temerature Regulatory Agency? Big winnings in the court room are sure to motivate folks. But again, if it's too hot, don't buy it. If you do buy it, don't carry it precariously. Also, if you put a sunshade in your windshield, remove it before going to get your tepid McDs coffee.
