As Biden heads out the WH door he makes a statement that the 28th Amendment is ratified. This will be a legal battle.

Biden says Equal Rights Amendment is ratified, kicking off expected legal battle as he pushes through final executive actions

“He is using his power of the presidency to make it clear that he believes – and he agrees with leading constitutional scholars and the American Bar Association – not that it should be, but it is the 28th Amendment of the Constitution,” the official added.
But legal experts contend it isn’t that simple: Ratification deadlines lapsed and five states have rescinded their approval, according to the Brennan Center for Justice at New York University’s law school, prompting questions about the president’s authority to ratify the amendment more than 50 years after it first passed.
Biden is leaning on the American Bar Association’s opinion, the senior Biden official said, which “stresses that no time limit was included in the text of the Equal Rights Amendment” and “stresses that the Constitution’s framers wisely avoided the chaos that would have resulted if states were able to take back the ratifying votes at any time.”

My opinion is that Trump needs to evaluate what happens if the 28th is ratified. Does it make any difference in 2024? Will it hurt business?

Much ado about nothing? Or, will it open the flood gates to frivolous lawsuits?

Sigh-------->it is all a Leftist smoke screen. It was not ratified in the allotted time frame, so has to be resubmitted to the states for consideration.

People already have equal rights under the law.

What they want are special rights for special people and push for unrestricted abortion rights of course.

The link said that there is no specific time frame. It also said that states can't rescind their ratification.

The states will do as the DNC tells them to do.

It's like immigration. Obama sued Arizona for trying to implement federal illegal immigration laws and won, because they are not the Feds. However, once Trump got into office, the DNC forbade Trump from implementing those same federal illegal immigration laws as states said they were now sanctuary cities

The bottom line is, the laws will always be twisted in favor of the DNC, because they really run it all anyway.

I have never understood why the Equal Rights Amendment was ever controversial, or why the right wing hates it.

Wrong there was a court case decided in 2021 and appealed and upheld in 2023 that stated it had not been ratified.
This one?

Federal appeals court dismisses ERA case in another blow to legal fight for supporters

A federal appeals court on Tuesday dismissed a case brought by two Democratic states that sought to have the US archivist publish and certify the Equal Rights Amendment as part of the Constitution.
The decision deals another blow to advocates’ legal efforts to get the amendment, which they say would ban discrimination on the basis of sex, recognized as the 28th Amendment to the Constitution.
“The States have not clearly and indisputably shown that the Archivist had a duty to certify and publish the ERA or that Congress lacked the authority to place a time limit in the proposing clause of the ERA,” the opinion from the US Court of Appeals for the DC Circuit states.

Here, want to know WHY this is now happening? Biden is trying to leave a mine field for Trump and the GOP congress. Here is a link with a 5 minute read that will tell you that Biden is full of poop as usual if taking past decisions of the supreme court as valid. All they are trying to do, is turn women against the gop, period!

Women don't have equal rights by the law. The NY people with special rights have been white men. Providing equal rights for others isn't giving them special rights. You are here saying you support restricting rights and don't want to be called a fascist.

How about those posters who support the proposed amendment but oppose the abuse of power?
