Mariner keeps insisting that the judge or hearing officer has to prove that the illegal alien is NOT here legally, and I’ve been saying that one can’t prove a negative.

To the contrary, the burden of proof is on the illegal to prove his asylum claim. Failing that, he gets deported - and there’s no requirement that he be tried and found guilty of an additional crime.
