Bíró filed for a patent in 1938, in 1941 fled Nazi Germany, however the ball point pen didn't make it to the US until the 1950s. I guess Anne Frank must have been living in the US....

Document research by the Netherlands Forensic Institute at the request of the Netherlands Institute for War Documentation (NIOD) revealed that most of the diary and loose sheets were written with gray-blue fountain pen ink. In addition, Anne also used thin red ink, green and red colored pencils and black pencil for her notes. But no ballpoint pen.

I guess it's a lie that the diary was written in ball point pen because it wasn't. In 1959 a document examiner was going through the diary to authenticate it and wrote a few notes off to the side. These notes were in ball point ink, That's where the conspiracy got started.
