Technically this correct. (Being undocumented does not equal being a criminal.)

There are two conditions (and if you don't like it, talk to Congerss they wrote the law):
  • Illegal Entry or Re-entry
  • Undocumented Presense

"Illegal Entry" is a crime (typically a misdeomenor for a first office, but still a crime). That means crossing into the United States without permission.

"Undocumented Presense" is not a crime, it is a civil offense that results in deportatgion and the barring of reentry for 3 years or 10 years depending on the situation.

So technically one can be undocumented and not have committed a crime. For example a person comes to this country legally on a student visa. Attends school, graduates, and then fades into the country side. That individual did not commit a crime, because they entered legally. They did commit a civil offense by not leaving when they were supposed to. Similar to Elon Musk who came here on a student visa, dropped out of school and didn't leave and worked. (NOTE: Musk later obtained legal status after illegally working and starting a business.)

[DISCLAIMER: This does not apply to Abrego Garcia who BOTH entered the country illegally (Illegal Entry) and remained (Undocumented Presense). But he entered as a minor and as such would not normally have been charged with a crime anyway.]

So technically just because someone is here in an undocumented status does not make them a crimingal. It depends on the method of entry.

In May 2021, Vasquez filed for another temporary protective order against Abrego Garcia, after a disagreement escalated into a physical altercation involving hitting, scratching, and ripped clothing.

I thought they were deporting him mainly because he's an illegal, not because he's a criminal/wife-beater...etc.

Except he isn't illegal.

He was temporarily legal after 2019, but did enter the country illegally circa 2013 when he was 16.

He was granted residency

No he wasn't. After his immigration hearings in 2019, he was determined to be deportation eligible, but a hold was placed in the deportation because the immigration judge ruled that he could not be deported to El Salvador, he had to be deported to a 3rd country.

The Trump Administration did not appeal the ruling, allowed Abrego Garcia to stay without futher pursuit of deportation and issued him legal authorization to work. This is a temporary legal status, but not the same as granting residency.

The Trump Administration could have sought deportation to an acceptable country, submitted that to the judge, had the hold lifted.

Being married to a US citizen (and even having US citizen children) doe not grant automatic residency. For someone with a clean immigration and criminal record it can be a factor in accellerated processing for residency, but it is not a determing factor.

Really? I had always thought it did. I thought that they allowed spouses of American citizens to stay in the country for humanitarian reasons, such as being able to remain close to their husband/wife.

The still need to apply for a legal immigration status by filing Petition for Alien Relative (Form I-130) showing the marriage. Then there is a review and interview process to determine the validity of the marriage (does it appear to be a marriage of convience used to circumvent other immigration laws). Does the spouse have prior immigration violations or criminal records in both the US and the foreign country.

If the marriage is less than 2 years old, and they pass the interview, and if there are no other factors (prior immigration violations, criminal history, etc.) then the spouse can get a conditional residency. Upon continued good behavior that can later be upgraded to permenant residency, and even later they spouse can apply for citizenship.

Had a buddy of mine who married a Scottish lady while stationed in the UK and a current co-worker that is married to a filipino.

Non-citizen spouses of US citizens can still be deported.
