Palestine had a legitimate government until the US backed coup in June of 2007.

PLO was never supposed to be a government just appointed to organize the palestinians till they were ready and could negotiate for a state. Oslo was the stepping stone.
Elections does not make a government. Church council can have an election. Government is services, mail, money, education, laws, treaties, trade, Not imposing one set of laws on this groups, without their consent, and a different set of laws for another groups, the two being incompatible.

The West Bank was part of Jordan, but Jordan didn't want this field of trouble anymore, so it gave up on it (It illegally occupied it, but that's a different issue). Since they didn't want the land, technically Israel's ruling upon it isn't really an "occupation" since it didn't belong to any country.

When offered the west bank back Jordan stated that as far as they were concerned Israel could keep it and deal with the Palestinian scum themselves. Egypt said the same thing so really the land now belongs to Israel as a gift.
