I would not say it is failed....just...it is not working as designed and needs some revitized.

One time when I got a simple DUI and went to court the room was full all DUI cases. The judge emptied the room before lunch.

It went like this:

Judge: Are Mack The Finger ?

MTF: Yes your honor.

Judge: reads my charges and ask for a plea.

MTF: I plea guilty your honor

Judge: Did anyone threaten you or make special promises for you to plead guilty.

MTF: No your honor.

The problem here is that this man is clearly mentally ill and should have been institutionalized. But our system fails these people; we just let thousands of them wander the streets until one of them goes off like a landmine.

Okay, did you go to jail for the DUI, or did your lawyer plead you down to a program? (which is what happened to my idiot brother a few years ago.)

Of course, if they were really that concerned with DUI, they could equip every car with a Blow-meter.

And this is the problem. This guy probably went in front of a judge every time he got busted for something. So either he was on his meds that day and complied with whatever the court meted out for his minor offenses, or he was batshit crazy, and the court didn't do anything about it.

Except there's no evidence this was a hate crime. The evidence seems to be that this guy was severely mentally ill and attacked this girl for whatever reason crazy people do things

What I see is a mentally ill person acting on whatever happens in a schizophrenic mind when not medicated.

28 years ago, I worked with a guy who was clearly somewhere in that realm. He got through the interview process okay because he was on his meds.

Then either he wasn't taking his meds or they stopped working, and then the strange behavior began. Shouting at imaginary people, strangely staring at the light fixtures.
