Last week, a Contra Costa County criminal grand jury returned murder indictments in the death of William Sims. The Richmond native, 28, was found dead on the street outside of a pool hall in El Sobrante in November.
While the grand jury determined the three suspects — Daniel Porter-Kelley, 31, of Richmond; Ray Simons, 32, of Hercules; and Daniel Ortega, 31, of Novato — should be charged with murder, jurors rejected the hate-crime enhancement.
It’s a remarkable turn of events because the Contra Costa district attorney’s office had previously charged them with murder with a hate-crime enhancement.
Sims, a beloved local musician, was black. A sheriff’s sergeant discovered Sims with his face battered and bloodied. He also had a gunshot wound in his forehead.
