Brief Comey Indictment Prompts Questions and Criticism.

ALEXANDRIA, Va. (AP) — A federal judge on Wednesday ordered prosecutors in the criminal case of former FBI Director James Comey to produce to defense lawyers a trove of materials from the investigation, saying he was concerned the Justice Department’s position had been to “indict first” and investigate second.


U.S. Magistrate Judge William Fitzpatrick instructed prosecutors to produce by the end of the day on Thursday grand jury materials and other evidence that investigators seized during the investigation. The order followed arguments in which Comey’s attorneys said they were at a disadvantage because they had not been able to yet review information that was collected years ago as part of an investigation into FBI media leaks.

Comey, who attended the hearing but did not speak, is charged with lying to Congress in 2020 in a case filed days after President Donald Trump appeared to urge his attorney general to prosecute the former FBI director and other perceived political enemies. Comey has pleaded not guilty, and his lawyers have argued that it’s a vindictive prosecution brought at the direction of the Republican president and must be dismissed.

Really bad DOJ, withholding material that should have turned over during discovery. This prosecutorial misconduct.

DOJ admits full grand jury never reviewed final Comey indictment, further imperiling case


The Justice Department on Wednesday admitted that the operative indictment against former FBI Director James Comey was never presented to the full grand jury — a procedural error defense attorneys say should bar the prosecution.

The admission came under sharp questioning from U.S. District Judge Michael Nachmanoff, after several judges overseeing parts of the case had raised concerns about the government’s presentation and an apparent discrepancy in the grand jury record.


Instead of presenting a new indictment to the full panel after it rejected one of the counts, interim U.S. Attorney Lindsey Halligan gave the grand jury’s foreperson an updated version — not seen by the other grand jurors — to sign.


Nachmanoff asked the government several times whether he understood correctly that the operative indictment was never shown to the entire panel.

“Yes, that is my understanding,” said Assistant U.S. Attorney Tyler Lemons.
He called Halligan up to the lectern to answer additional questions, as she was the only prosecutor who made the government’s case to grand jurors for an indictment.

“Am I correct —” the judge began.

“No, you’re not,” Halligan interrupted, clasping her wrists behind her back.

She said that the grand jury foreperson and a second grand juror were present in the magistrate’s courtroom, recalling the proceeding. The judge said he was familiar with the transcript and directed her to sit down.

Michael Dreeben, an attorney for Comey, told the judge that the apparent error calls for dismissal because “no indictment was returned.”

The judge also appeared puzzled after a lead prosecutor said he couldn’t reveal whether career attorneys initially recommended against charging the former FBI director.

ALEXANDRIA, Virginia — The Trump administration’s criminal prosecution of former FBI Director James Comey appeared to be in serious jeopardy Wednesday as the federal judge overseeing the case repeatedly questioned the validity of the grand jury indictment charging Comey with lying to and obstructing Congress.

U.S. District Judge Michael Nachmanoff pressed prosecutors during a hearing on the events around the Sept. 25 charges against Comey, questioning whether the entire grand jury ever saw the two-count indictment that a magistrate judge received after the grand jurors rejected one of three charges proposed by interim U.S. Attorney Lindsey Halligan.

Nachmanoff, a Biden appointee, was so intent on establishing the precise sequence of events that day that he briefly called Halligan to the courtroom lectern, prompting her first substantive public remarks since she secured the charges.

You’re counsel of record. You can address the court,” Nachmanoff said to Halligan, asking her to explain whether grand jurors beyond the foreperson were present when the original indictment and a narrower substitute one were presented to a magistrate judge.

She fucked up by the numbers. This prosecutorial misconduct at it's worse. To deliberately withhold the substitute indictment This dufus should be disbarred.
 

Because Trump's prosecutor, his preferred blonde female, obviously doesn't know what she's doing. She typifies the vast majority of Trump's appointees, a basic lack of qualification for the position they are appointed to. In Halligan's case, being blonde and appealing to Trump was probably the only requirements she had to fulfill! I bet Comey smiled and applauded when he heard of her appointment. Another prime example of Trump's total ineptitude!
