The Supreme Court said Tuesday that the controversial Trump-era border restriction known as Title 42 will remain in effect while legal challenges play out, a move that ensures that federal officials will be able to continue to swiftly expel migrants at US borders at least for the next several months.

The 5-4 order is a victory for Republican-led states that urged the Supreme Court to step in and block a lower court opinion that ordered the termination of the authority. The Biden administration has said it was prepared for the authority to end and had put in place precautions to guard against confusion at the border and any potential surge of migrants.

It's the Executive's job to form policy and Congress's job to make the laws.

SCOTUS only looks to see if the laws or regulations enacted pass constitutional muster.....They are not the policy maker of last resort.....That's called being a activist court.

I disagree, changing the status quo while challenges remain would create chaos if lower courts ruled in favor of maintaining the policy. The court is not being activist in the least, they too have a duty to maintain stability until the full issue is addressed.

Is the policy constitutional? That's all they need to decide on. They don't make policy. "Stability" is not their concern. It's up to the lawmakers to do that.

The dems thought RvW was 'stable' after 50 years but SCOTUS thought differently. They did not create a policy, they just struck a un-constitutional ruling down and sent it back to the states.
