Very different.

Your definition is based on "hate", when in fact the definition simply calls for a desire to discriminate against. A desire to discriminate need not be born out of "hate".

For example a person may not "hate" homosexuals, but feel - for religious reasons - that they should not be treated the same as heterosexuals under the law. That isn't "hate", but it is a call for discrimination.

Nope. They may have been able to make Webster's or Merriam's more PC, but the truth is phobia is based either on fear or hatred, usually one that is irrational. Christians were taught from birth that homosexuality is wrong for a reason. I tend to believe that folks hate Christians because of a phobia against being judged or discriminated against.

In the case of Kagan, we have an unbelievable display of overt bias in addition to the shadow-bias the entire Court is displaying to the public: Justices Indicate Shadow-Bias Gay Marriage Question Erodes Last Bastion of Impariality Page 40 US Message Board - Political Discussion Forum

This is behavior unbecoming on an unsettled question of law for a US Supreme Court Justice. I just stumbled upon this today:
WASHINGTON (AP) — Justice Elena Kagan has officiated for the first time at a same-sex wedding, a Maryland ceremony for her former law clerk and his husband.
Kagan presided on Sunday over the wedding of former clerk Mitchell Reich and Patrick Pearsall in the Washington suburb of Chevy Chase, Maryland. Supreme Court Justice Elena Kagan Performs Her First Same-Sex Wedding
WASHINGTON — The Supreme Court ruled Monday that elected judges must step aside from cases when large campaign contributions from interested parties create the appearance of bias...Voting 5-4 in a case from West Virginia, the high court said that a judge who remained involved in a lawsuit — one filed against a company helmed by a generous supporter of the justice's campaign — deprived the other side of the constitutional right to a fair trial.Court Judges must avoid appearance of bias - politics - Supreme Court NBC News
By the Court's 2009 Finding, Kagan must recuse herself from sitting on the upcoming Hearing on gay marriage.

nothing requires a supreme court justice to recuse him/herself.

otherwise the husband of the tea-tard (Clarence thomsas) would have had to recuse himself from citizens united.

But don't worry. June is coming soon enough to take care of even that.

Laughing.....so a traffic ticket and systematic discrimination against gays and lesbians/the denial of fundamental civil rights is the same thing? That's your latest argument.

No wonder your ilk have lost 44 of 46 cases. You're not exactly bringing your 'A' game at this point.

the fact that you have zero understanding of the fact that it has EVERYTHING to do with the constitution and what it protects indicates you probably shouldn't opine on this issue.

You mean people that believe in following the law?

Violating rights isn't 'following the law'. And virtually every federal court to hear cases on gay marriage bans have ruled that they violate constitutional rights. With the USSC preserving every ruling that overturns gay marriage bans. And denying stays for every state attempting to defend them.

But you keep running with that 'a traffic ticket is the same thing as denying a fundamental civil right' schtick. Just don't expect much more headway in court with that rhetorical load than your ilk have enjoyed in the rest of their near perfect failure in court. Though do expect a fair laughter.

false equivalence. there is no constitutional right to protect against traffic violations. however, if you enforce those regulations unequally, based on race, gender or any other illegal criteria, then it could be a constitutional (i.e., equal protection) issue.

now try again.

What was the punishment for getting married to someone of the same sex before they made it legal in a number of states? From what I understand it was simply not recognized. Many of the same benefits were already given gays before legalization anyway. What exactly did they want?

Answer: Total acceptance

They wanted to somehow be accepted by society and to have legal recourse against any who do not accept them. This is why they claim this is a civil right. On the other hand, how are they going to rid themselves of their own hatred of folks that cannot change for one reason or another?

I simply pointed how both were illegal. I didn't delve into precisely what sort of statutes they were associated with.

Some people feel abortion is murder, and it is, but somehow you liberals have been able rationalize it away through judicial activism.

There is no punishment. It simply wasn't recognized. You don't seem to get the difference between a crime and something that has no legal recognition. The former is punishable by jail or fines. The latter is simply ignored.

I take it law isn't your bag.

What exactly did they want?

Legal recognition of their marriages and ALL of their rights and protections. Not just 'some of them'. As would any rational person.

They wanted to somehow be accepted by society and to have legal recourse against any who do not accept them. This is why they claim this is a civil right. On the other hand, how are they going to rid themselves of their own hatred of folks that cannot change for one reason or another?

They call it a civil right because it is a civil right. And its not 'gays' alone that have called marriage a civil right. That would include the Supreme Court:

"Marriage is one of the basic civil rights of man"

Loving v. Virginia (1967)

And with support for gay marriage continuing to surge, now outpacing opposition by 12 to 19 points, their fight for their civil rights seems to be winning them public support as well. The hate I leave to your ilk.

How do you violate an unconstitutional law? And of course, you equated a lack of legal recognition with a crime. A same sex marriage violated no law. It simply wasn't recognized as legally valid. While traffic violations are crimes.

You may not be able to tell the difference. A rational person could.
