One would assume that any president packing a box of classified materials would think to himself "those are now declassified", at which point they would be. Unless you can prove that he didnt think it, how could you possibly charge him with anything? The answer is, you cant charge him, which is why they wont.

It is absurd and false. No, Trump claiming he thought 18 months ago that the docs were declassified does not now make them declassified. That is hilariously dumb. That's why team Trump wouldn't make that stupid claim in court.

Trump isnt any other president. That is EXACTLY how Trump would do it, but you are missing the point here. You are actually half right.

The DOJ knew that they could play dumb and say "we had no idea that he declassified them, so it was illegal in our eyes". That will absolutely work for them. They are perfectly insulated with that excuse. On the other hand, they know that they will never be able to charge him because all he has to do is say "I declassified those" and its over. He will NEVER be charged for those documents. NEVER.

They just did it to try to sway the midterms. Thats also why they hid the fact that Biden got busted with classified documents 6 days before the midterms.
