O'Connor has been talking about Biden's health for a very long time. He gave up his privilege then.

Doctor/patient privilege doesn't extend to the question he was being asked, which was whether or not he (the doctor) was asked to lie about Biden's condition. It has nothing to do with Biden's health, it was a question about the doctor's own actions. We know he lied, because Biden has stage 4 cancer and the doctor never revealed that.

The 5th Amendment applies in that case.

Woven into that right however is a suppressed premise: that is that honestly answering the question could (theoretically) get him into the mix of a criminal prosecution.

The world saw Biden in his day to day activities and during the now infamous debate with Trump. Regardless of what a doctor says, people will formulate their opinions based on the eye test.

I suspect that, to the extent any doctor signed off on a medical report about the then incumbent President which was known to be false (or should have been recognized as being false), the desire not to testify about the basis for that medical opinion is more about keeping his license and reputation.

It is a certainty that Pres. Joe McAlzheimers “Potato” Brandon was not playing with a full deck.

You can grant till the cows come home, MAGAt. But unless the individual agrees to it then he doesn't have immunity. And the courts cannot give immunity for the Hippocratic oath that far exceeds time well over modern government models.

He doesn’t have to agree, if the government grants it, it’s a done deal, this is how they did with mobster Giancana in the 70’s and the doctor can refuse to testify and he will be held with contempt of court.

The courts have rule against doctors privilege, it is rare but it has happened. Two such cases:

1. People v. Wharton (1984, New York)
   A doctor was nearly held in contempt for refusing to testify about a patient who had confessed to a crime during treatment. The court ruled that doctor-patient privilege did not apply because it was relevant to a criminal investigation.
2. State v. Betts (Tennessee, 1991)
   A psychiatrist was held in contempt for refusing to release mental health records in a homicide case. The court ruled that the need for justice overrode the privilege.

So it can happen, and there are other cases. But, government can file contempt charges and turn him over to the DOJ.
