Our Constitution gives the president the power “to grant Reprieves and Pardons for Offenses against the United States, except in Cases of impeachment.”

If the murder case is a federal prosecution, the President has authority to grant a pardon or to commute the sentence.

If the murder case is a State prosecution, then the President has no such authority.

As I understand it, presidential pardons can only be done for federal offenses, but we've seen that a federal charge could possibly be redefined in a state court of law. Which is what NY did to Trump, the original federal crime was not pursued so the democrats went after Trump in a NY state kangaroo court run by a progressive liberal judge. Turnabout is fair play.

Pre-emptive pardons are a very bad idea IMHO. You can go after a political foe without restriction, knowing you have a get-out-of-jail card. Both sides are going to do it, and the dirty business of politics is about to considerably worsen. As if the justice system wasn't already dishonored and distrusted already.
