So just because someone commits an “act of war”, doesn’t mean they’re at war.

Perhaps we need to redefine “act of war”.
It would be simple for you guys. You could do most whatever you wanted while you were in power but the other side isn't allowed to do the same.

In most of history of the past 150 years, there have been many acts of war against the USA. Most of them were not acted on.

So, an act of war, in our case, only happens when the feckless Congress declares it.

Until that time, this is just another of many hot actions taken in the past.

I'm saying that if another country is at war with us then we are already at war. When you are already at war then you don't need a war resolution from Congress. You didn't even bother to answer the question.

LOL. I think is is self explanatory that when another country has committed an "act of war" against you then you are at war. That's why they call it an act of war.

Russia committed an act of war against Ukraine. Ukraine could have just let Russia take over territory and done nothing and claimed that even though Russia committed an act of war, they don't really consider themselves to be at war with Russia. Wouldn't that be rather stupid? Whether Ukraine liked it or not, they are at war with Russia. They didn't need to declare being at war with Russia because Russia had already declared war by committing an act of war against Ukraine.

So, you're saying that, according to the Constitution, if another country attacks us we can't attack them back unless we declare war against someone who has arleady attacked us? Let me ask you the same question I asked Candycorn:

Let's say for the sake of argument that the whole world is at peace, but we have our usual enemies, one being Russia, but that we aren't "at war" with them. Putin decides to pre-emptively nuke Congress when it is in session while our president was lucky enough to be away from DC. Since Congress has been nuked, wouldn't you want the president to defend us, even though we can't get a vaporized Congress to declare war on Russia? Isn't Russia's act a clear act of war and we don't need to wait for a new Congress to declare war against them?
