The idea of pardons is the legislature passes the laws, the executive prosecutes the laws, the judicial branch runs the trials.

The pardon is the last resort after all the other branches have had their say.

Joe Biden has given "pardons" to people who haven't been formally accused of breaking any law, so out goes the legislatures part, haven't been indicted, so out goes the executives part, and haven't been tried, so out goes the judicial branches part of it.
