Anything can happen on appeal, but the appeal isn't about did he commit the offense. The vindictive prosecution is based on whether the prosecution was just. DOJ had the traffic stop for years, closed the case and only reopened it to prosecute Abrego Garcia when he embarrassed the President and DOJ. The appeal will be based not on the traffic stop, but whether the prosecution was vindictive which is clearly was.

And No, it wasn't human trafficking. Which under the law has a very specific meaning.

He wasn't charged with Human Trafficking (18 U.S. Code § 1590 - Trafficking with respect to peonage, slavery, involuntary servitude, or forced labor).

He was charged under 8 U.S. Code § 1324 - Bringing in and harboring certain aliens. Commonly referrred to as human smuggling.

The difference is that human trafficing involves forced slave labor and often protestution of women. Which is not the case here. The charge is "human smugglindsg" which typically involes voluntary movement of illegal aliens for financial gain from one location to another.

With no evidence or mention of evidence other than the TSP stop and the word of an informant that got a sweetheart deal for making claims.

Please show us in the indictment dates, times, locations other than the TSP stop. Not the "claimes" but the actual date, times, locations.

If I were Abrego Garcia's attorney, I'd already - and given that Abrego Garcia was given legal authorization to work and was a union apprentice - I'd have work schedules, tax forms (W-2's, 1099's), EE and ER Social Security records for FICA taxes, and employer/union time and labor records, bank records, credit card records, etc. that show his location activity ready to go.
