Military members are NOT left to their own as to what are legal and illegal orders.
They make a choice, then become subject to the Uniform Code of Military Justice.
They can be arrested and submitted to a Courts Martial. The prosecution makes it's case, the defense makes their case, and then the Military Judge makes a ruling (assuming a motion to dismiss). If the Military Judge determines there is a question, then a military jury is empaneled and the case goes to trial. Then it is the military jury making the call on guilt or innocense.

While we wait on all of this to be adjudicated, orders are not being followed. This is why it is dangerous for military personnel not to follow an order unless the order is blatantly illegal. In the current context, there are no such orders.
