1942

Yes! Lets celebrate the Supreme court making laws from the bench, making things up, and presidents abusing their powers and going against the founders!
YES!!!!
I bet you love the patriot act too. I bet you bitched about warrantless surveillance on trump though, didnt ya?
They make leather boots for just this type of situation.

But Congress passed it. Back around 2001 after roughly 200 years of using it lol

I'm playing with you. You don't have the first clue

So if Congress passed it and SCOTUS hasn't struck it down Trump can use it like his predecessors.
I understand now. Thanks!!!
To these dipshits, an act of war is a declaration of war, so we are already at war with Iran.
Once we are at war, whatever restraints the constitution places on the Article II powers of the CinC, they go away.
This means the War Powers Act no longer applies, and Congress has no constitutional power to limit the CinC.

The POTUS can’t “declare war” against another country, but he can “use military action” against another country.

Is the way we’ve been doing this what was intended by the founding fathers? I doubt it.

A few things:

- I think our Constitution should have been more clear on this.

- I think we should have fixed this loophole by now, which has been exploited by both sides.

- I think it’s troubling that we’re still running into these kinds of system issues this far into our nation’s existence.

- I think the POTUS has too much power.
This is alexander hamilton right after tripoli declared war on us
"The Congress shall have power to declare War;" the plain meaning of which is that, it is the peculiar and exclusive province of Congress, when the nation is at peace, to change that state into a state of war; whether from calculations of policy or from provocations or injuries received: in other words, it belongs to Congress only, to go to War. But when a foreign nation declares, or openly and avowedly makes war upon the United States, they are then by the very fact, already at war, and any declaration on the part of Congress is nugatory: it is at least unnecessary."

Congress passed the patriot act.
200 years of using what? We used to have declarations of war.
No, you are playing with yourself. You dont know shit.

It's not always about an act of war. At times measures have to be taken for the good. Iran has a history of terrorism, crimes against their own citizens, trying to obtain nuclear capability, etc.

At some point it had to stop

No, they are the ones that made up delegation of powers.
I understand congressed it, but just because congress passes something, doesnt make it constitutional. Congress passed the patriot act and that bypassed several amendments. Our rights, and powers of the government, dont just go away or appear, because congress signs some legislation.
they made up the war powers act. PERIOD.

make me laugh. You prefer grannies and kiddies getting killed rather than removing that evil using those who risk their lives to protect the grannies and kiddies.

Every POTUS between 1942 and now:

“Just because I’m bombing your country and killing your military doesn’t mean we’re ’at war’.”

Congress passed AUMF which is not part of the Patriot Act. Where did that come from? You don't have the first damn clue what you're babbling about. Get caught up and try again.

correct, I'm telling you I'm stopping you from doing that.

I don't disagree --point is, the dipshits are mindlessly crying "Only congress can declare war!!!" while refusing to understand an act of war is not necessarily a declaration of war.

The CinC, unquestionably, has the constitutional power to commit acts of war against another country absent Congress declaring there is a state of war against that country; this fact is recognized by Congress in the War Powers Act.

Is that a serious statement?
It's a challenge for you to prove your claim.

Cite the Article/Section and copy/paste the text where the Constitution says the President needs to consult with Congress while prosecuting a declared war.

Good luck with that.
