WSJ: Former President Trump Is Obviously Innocent Based On The Presidential Records Act

'President Trump gathered newspapers, press clippings, letters, notes, cards, photographs, documents and other materials in cardboard boxes. Then Mr. Trump, like Mr. Clinton did, took those boxes with him when he left office.

As of noon on Jan. 20, 2021, whatever remained at the White House was presidential records. Whatever was taken by Mr. Trump wasn’t.

That was the position of the Justice Department in 2010 and the ruling by Judge Jackson in 2012.

A decade later, the government should never have gone searching for potential presidential records. Nor should it have forcibly taken records from Mr. Trump.'

If you listen closely enough you can hear Spevial Counsel Durham.in the background saying, 'The FBI SHOULD NEVER HAVE OPENED CROSSFIRE HURRICANE.'
The FBI SHOULD HAVE NEVER:

- Protected Hillary Clinton for her stolen classified crimes.

- Illegally participated in a failed coup attempt based on the Hillary Hoax.
- Opened 'Crossfire Hurricane'
- Defrauded the FISA Court
- Illegally altered warrant documents
- Violated the Constitution
- Violated the Patriot Act
- Illegally spied on a US President & his Cabinet
- Illegally spied on Americans
- Committed Election Fraud by pushing the Hillary Hoax

- Committed Election Fraud by hiding Biden's / Blinken's 'Russian Disinformation' Hunter Laptop scam

- Committed Election Fraud by hiding Biden's massive classified theft scam until after the 2022 elections

- Committed Election Fraud by conducting an unprecedented,1st-ever,unwarranted heavily armed / armored raid on a former US Presidrnt's home with fill camera crew, looking for material covered under the Presidentisl Records Act
- Hidden all of Joe Biden and his ofamiy's crimes:
----Hunter's Laptop
--- Biden's Bribe
--- Biden's classified scandal
--- Connection to Russian prostitites / trafficking
--- Money Laundering / Financial records

--- Etc.

Poor easyt65. Flailing and grasping at any straws from the right wing media to protect the man he/she loves.

Jackson's ruling applied to personal items, not presidential records.

Good thing for your masters you are ignorant as fuck or you wouldn't fall for it...every... single...time.

"U.S. District Court Judge Amy Berman Jackson, an Obama appointee, dismissed the case in 2012. Jackson said the law distinguished the tapes as "personal records," distinct from "official" records. She wrote that the National Archives does not have the authority to designate materials as presidential records and lacked authority to seize control of them.

The Presidential Records Act requires that all "official" documents be returned to the National Archives upon a president’s departure. Former President Jimmy Carter signed the act in 1978, building upon legislation by Congress to stop former President Richard Nixon from destroying tapes linked to the Watergate scandal.

But Jackson wrote that the act described "personal records" as including documentary materials, diaries or journals that don’t relate to carrying out official duties."

Now go ahead and predictably screech fake news...unless you consider this to be personal records...from the indictment you didn't read...

According to the indictment, Trump had stored in boxes information "regarding defense and weapons capabilities of both the United States and foreign countries; United States nuclear programs; potential vulnerabilities of the United States and its allies to military attack; and plans for possible retaliation in response to a foreign attack."

'Although the indictment against Donald Trump doesn’t cite the Presidential Records Act, the charges are predicated on the law. The indictment came about only because the government thought Mr. Trump took records that didn’t belong to him, and the government raided his house to find any such records.

This should never have happened. The Presidential Records Act allows the president to decide what records to return and what records to keep at the end of his presidency.

And the National Archives and Records Administration can’t do anything about it. I know because I’m the lawyer who lost the “Clinton sock drawer” case.'

Then again, Donald Trump is being pursued / tried by Stallinist/ Maoist extremists who have demonstrated they care more about power and using that power to destroy their political enemies and crush rhose who oppose their policies and agendas than they care about the Constitution and Rule of Law.

Are you people really so pathetically desparate to save the Orange Ogre's ass that you will believe anu old bullshit that you come accross?

You might want to look at this:

The Wall Street Journal on Wednesday published an editorial written by Michael Bekesha of the right-wing organization Judicial Watch that declares former President Donald Trump innocent of any crimes based on precedent established during litigation surrounding the Presidential Records Act

To start, Whelan argues that Bekesha "makes wild wrong turn in his very first sentence" by incorrectly arguing that the criminal charges being brought against Trump are predicated on the Presidential Records Act, when nothing of the sort is true.

Added to this, Whelan notes that "classified docs Trump retained were agency records outside scope of PRA," which he said specifically excludes such documents as being classified as presidential records And even if the initial premise of Bekesha's column is correct, Whelan writes, he would still be completely wrong about the substance of the PRA.

They have no problem debasing themselves.

They have no shame.

And yet another Trump humper repeating what his media masters told him/her and pretending to be a lawyer.

Sorry, you were told wrong...on purpose.

"The PRA distinguishes Presidential records from “personal records,” defining personal records as “all documentary materials, or any reasonably segregable portion thereof, of a purely private or nonpublic character which do not relate to or have an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the President.”

Even if non personal documents were found, it's not a criminal offense under the PRA.

This is all fun and all until you read the Presidential Records Act..

It seems to apply to CURRENT PRESIDENTS and what they "DON'T HAVE A RIGHT TO" AFTER they are no longer president...

And who is this "archivist" person anyway and why are they so special....damn PRA
Prove a document wasn't declassified while Trump was POTUS. Remember, a POTUS does not need anyone to O.K. declassification. He can do it at a moment's notice.

Hate to rain on anyones parade, but classified national defence documents generated by the military are not presidential records and have nothing to do withe the Presidential Records Act.
The President could still declassify them.

What harm came from misplaced boxes?

What harm could come from storing nuclear secrets at a resort?

I don't have time for sea lioning.
First of all, you don't know there were any nuclear secrets, second, Mar-A-Lago was guarded by SS agents. Unlike Joe's garage that had boxes of documents he had no business having in the first place.

The FBI brought the case, part of the executive branch which Biden heads.

So yes, Joe Biden is trying to jail his political opponent
President Trump's guilt or innocence is not at all the issue.

The overt and flagrant abuse of the law by the leftards is the issue.

But it is a criminal offense to violate the espionage act for which 31 of the indictments are based.
Fake charge, he was not willfully withholding national defense information. Also Trump is accused of violating the ACT not of actual espionage. They have to prove he was going to commit espionage. Retaining the records is NOT a criminal offense.

This is cut from an OpEd by a shitty Judicial Watch lawyer who unsurprisingly lies about the case he lost.
You’ve attacked him personally yet you have not countered with opinion supported by fact.

Ummm................hate to tell you but the Secret Service agents are there to guard Trump since he's a former president, NOT the place he lives at. Where Trump goes, the agents go, and if Trump leaves Mar a Lago, the agents travel with him, meaning that Mar a Lago is not being guarded when Trump isn't there. You really need to study up on this stuff a bit so you don't look like the total idiot you keep appearing to be.

Sure, that's why they were looking to put in SS quarters on the property. Come on.

Ever consider that they have to have someplace to stay that is close by when guarding him? They are there to guard the former president and his wife, NOT the estate.

C'mon. I thought you were smarter than that, but apparently I was mistaken.
