How can an amendment to the Constitution be unconstitutional sealy? The amendments are basically updates to the Constitution, which means they are part of the Constitution. An amendment to the Constitution cannot be unconstitutional.

Now is it true that the founders would never have put anything like the income tax in the Constitution, absolutely. As I said, I do not agree with the income tax and support repealing the 16th Amendment. However, it is certainly Constitutional.
