on class action lawsuits.....stop the crocodile tears, you guys don't like loser pays, so we know you're full of shit.

Why

loser pays would mean people could hire better lawyers but only if they have a legit case, It would prevent bad cases because lawyers would have to go to court and couldn't get a company to settle because it was cheaper...….

While the answer may be interesting it is rather irrelevant to the case itself. If the ruling is not leading to a desirable outcome congress can simply pass a law. If there really is a 'blue wave' coming then you should have your chance in a few years.

Loser pays has a SERIOUS cooling effect. Those with legitimate claims but insufficient resources to do a full battery of litigation will be less likely to bring those legitimate claims.

Basically, poor people are fucked.

I am pro business as much as anyone, but the whole "loser pays" recourse is already sufficiently available with findings of frivolous filings. Attorney's fees are available if the suit had no reasonable basis in law or fact.

What stops most large companies from wrongdoing is not class action suits - those are pretty rare in the first place. Fines and legal repercussions prevent most of it.

The answer to companies not screwing people over is not 'give lawyers millions of dollars.' That is a piss poor reason to continue a practice that is supposed to bring restitution to the victims. I don't think arbitration is a good answer either though as the 'neutral' arbitrator actually represents the entity that is paying for them - the company.

Well you do loser pays, so it can be fought out in court by good lawyers on both sides. Class action lawsuits are known scams, the lawyer is the only that makes real money. Most lawyers hate loser pays because they don't want to go to court, they want to have the company settle because it's cheaper than going to court.

The problem is the damages per victim are so small. How else do you stop the wrongdoers ?

Big Corp swindles you out of $1.00. You going to sue? Meanwhile they do that to
1,000,000 people and make killing .
