Hope BOA enjoys the lawsuits coming their way. Handing those over with no subpoena or legal reasons is a clear legal violation of customer's rights. So of course the left has no problems with this.
 
The people who complain about this stuff don't seem to be able to come up with a plan to catch the terrorists who invaded the Capitol with the intention of, at very least, assaulting Congress. The mishandling of the Jan. 6 attack allowed the terrorists to scatter. Law enforcement compiles lists all the time, and then eliminates people from that list. How else are lawbreakers going to be caught? I live in northern Virginia and there are plenty of hotels and motels that these scumbags might have stayed in They must have made credit/debit transactions.
 
You need a suspect before you get a warrant for accessing someone's financial accounts. This is an invasion of privacy, nothing less. There should be a class action law suit against them Monday.
Supposedly the financial records are going to show up in court, the defense attorney will ask the prosecutor how the bank statements were obtained without a warrant, and the judge will declare a mistrial or throw the whole case out for lack of evidence.

But of course not. That's for law school freshmen. The seized and confiscated records are circulated among police stations and federal "fusion centers" and used for "extra-legal" punishments, civil asset forfeitures, and other adverse actions that may be taken based on the information itself rather than its presentation in court, which will probably never happen.

Since this is apparently new for you all. Let’s get started explaining how things really work, and how they have worked for a long time.

In the Supreme Court Decisions Smith V. Maryland and United States V. Miller the Supreme Court held that banks, and other institutions providing information to Law Enforcement was proper and correct even if there was no warrant. Why? Because when you provided the information to the bank, you surrendered your Fourth Amendment Rights. You no longer had a Reasonable Expectation of Privacy. These decisions were from the 1970’s and 1980’s. They’ve been around for a while.


To show what Congress thought of these decisions, you need only try and open a Bank Account. The Federal Government requires the Banks to get all sorts of identifying information on you, before they are allowed to open a bank account for you. And it gets worse. If you walk in with ten thousand dollars in cash. Let’s say you have been putting money aside every week in an emergency fund, and are worried that you have too much cash that can be stolen. Well, you have to fill out a form explaining where you got the money.

Now, for decades the Right has argued that this is good. You see, when it was anyone but them being subjected to these violations of our Civil Rights, that was fine. If you have nothing to fear, you have nothing to hide. Does that sound familiar? It has been the battle cry of the Right whenever the Civil Rights are discussed. If you have nothing to fear, you have nothing to hide.

Your cell phone is tracking you right now. You can’t turn it off. Why? Congress passed a law requiring any cell phones sold in the US have GPS position data available. This was for your safety. That way if you dialed 911 and were unable to speak, or were confused as to your actual location, emergency personnel could still reach you. Of course, ten seconds later Stingray and other systems were created to gather this data for the Government.

Now all of a sudden these practices that have been going on nearly my entire life are wrong. They’re outrageous. They are an abomination. They show a Government oppressing the people. They have been doing this to you for decades, and you cheered it. You denounced the Left as loving Criminals if they objected to this. The FBI whipped you into a frenzy explaining that Drug Dealers and Child Predators would continue to prey on society if they didn’t do this. You cheered it. You had nothing to fear, so you had nothing to hide.

Now, all the predictions are coming true. The old story that you ignored. First they came for the Socialist, and I did not object. Because I was not a socialist.

When we who cared about Civil Rights objected, you accused us of being criminals, or criminal lovers. You accused us of being drug dealers, or child predators. You told us time and time again, if you have nothing to fear, you have nothing to hide.

Now, you’re finding out how awful it is to have your rights trampled, and it is outrageous. It is a whole new game. You either don’t know, or don’t care that this has been going on for Fifty years.

The Feds don’t need a warrant. In fact, by Law, the local cops don’t need a warrant. It is called No Reasonable Expectation of Privacy. Two Supreme Court decisions set this in motion. And they aren’t recent. They’re very old. The first was from the 1970’s.

Congress responded to the cheers of the Law and Order Crowd. By requiring the banks to gather even more information on their account holders. This way the Cops could get even more information on you. We had to do this you see. It was the only way to stop Drug Dealers, Child Predators, and international criminals.

The Left has been complaining about this for years. The Left fought it in court in the 1970’s and 1980’s. The Left lost when the Supreme Court decided that bank customers had no reasonable expectation of Privacy. See United States V. Miller.

The ACLU has tried to fight it since that time. But the Right has always argued that if you have nothing to hide, you have nothing to fear. Now, the tables are turned, and the Right is acting like this is all new shit. It’s never been done before. It’s been done a million times before. Welcome to America.

Look at the numbers at the bottom of your check when you pay your bills — who's pilfering all the money from your bank account if it isn't the FBI?

It's an ACCOUNT. Every transaction involves multiple parties unless you maintain passbook savings account and use cash only for all your transactions.

You can't stump the FBI with a plain old checking account.

If I had anything to hide at the bank I would presumably use a safe deposit box, rather than a demand deposit account.
