FALSE report. Jacobs pushed a cell phone recorder in Gianforte's face (a valid reason for self-defense action already), and Gianforte, instead of pushing Jacobs away (which he had every right to do), politely asked Jacobs to take the phone away from his face.

Jacobs (already acting criminally) refused, and when Gianforte attemped to grab the phone that was pushed in his face, Jacobs grabbed Gianforte's wrist (another criminal act), and spun away from Gianforte, pushing both of them to the ground.

As for misdemeanor assault charge, any kind of a charge can be given to anybody depending on the political persuasion of a particular judge or jury. In this case, it is Jacobs who should have been charged with battery (at least 2 counts)
