Depends on the crime and if people are prosecuted fairly which doesn't occur in America where the sentence differentials between possession of crack and powder cocaine, which has been proven to not be more potent than powdered cocaine, is 17 to 1. Which is better than the 100 to 1 ratio where 5 grams of crack and 500 grams (half a kilo) would net the same 5 year minimum sentence.

2. No. Wishing harm is not the same as actual harm and is 100% protected by the First Amendment. You can't claim self defense in killing someone by saying "They wished harm on me so I shot him dead." That's just ridiculous.
