New York city man sues neighbor over Christmas music

If the person doesn't like what they hear enough, there is nothing forcing them to stay there, its their life. They are free to go somewhere else at anytime and if they really are a lawyer, well then you know that they have the money to relocate anyways.

There is nothing forcing the noise pollutant to play xmas music 24/7 either. The person shouldnt be forced to move anywhere just because of the rude person. The noise laws are on the side of the person being tortured.

I would be labeled as assault regardless of xmas music being considered torture. One has nothing to do with the other. Why do you ask?
 
^^^ Why should the person playing it have to turn it off because the guy can not handle it? It isn't like he is being beaten on every night? Maybe the guy should think about those who are and then see how severe his situation is then.

Because there are laws against noise pollution. You dont have a right to play music at a level your neighbors are disturbed by it.
 
^^^ Well with there being laws, the authorities will be who decides on whether or not her music is too loud and if they don't think that her volume is loud enough, I guess that will put the man out of luck.

Unfortunately for her, the fact that he heard the music pretty much guarantees he is going to win. All he needs is a recording or a witness to say they also heard it.

P.S. If the guy wants a more quieter environment, he should start packing. If he were in New York City, would he have the ability to bring a stop to whatever noise is outside his bedroom window? No and its because at the end of the day, the only person that he has any real control over is himself.

No he doesnt have to start packing. The laws protect his right not to have to be tortured by the persons music. Remember he is an attorney and knows the laws better than the noise polluter and even you.

I like chrismas music, but it can be overwhelming when it runs nearly 24/7 for more than a month, everywhere.

During normal hours of the day and not exceeding noise levels, enjoy

It's just nice music but why so many like to celebrate at the wrong time of year is social not religious. Early church did not even give him a date of birth, and then gave him the birthday of other god.

If a nation wanted to celebrate 4th July in March it would also be weird, but patriotic music is great, just not so loud you induce migraines.




Merry Christmas, just don't expect me to play music from outdoor speakers at all hours for the whole neighborhood

He'll only win if her music is actually too loud in the opinion of whoever has the final word on the matter. If he is suing the girl because he doesn't like what he happens to hear coming from her direction, then I hope he has the money for whatever fees and court costs get dumped on his plate.

"Too loud" is when someone else can hear it. There is no need for an opinion on it. Plus she plays it all night? Shes going to loose.
