More on the prom canceling

How can her rights be violated? No One has a RIGHT to a Prom. And the school is NOT holding a Prom. The Judge is an idiot. Is the Judge going to ask the Federal Government to pay for this Prom? This loses on every level.

Use your head. The fact that they excluded her from the prom violated her first amendment rights. They canceled the prom due to her challenge.

The judge didn't say that she had a right to a prom. That is why he didn't order the school to hold one. He said that the school violated her rights by excluding her.

There is no prom there for she was not denied the right to attend. Pretty simple concept.

Is it really hard to get the fact they denied her access to a public school sponsored event?

The bigotted school board, or whoever ruled the prom cancelled, ruined it.

The other choice was a lawsuit by the ACLU, I don't blame them for canceling the prom, given the circumstances I would too. She is responsible for the prom being canceled. Heck she planned it, did you not read that she went to them in December and again in February, she wanted to make darn good and sure they knew she was gonna wear a tux and bring a female date which was against the school rules. Then she's surprised that after getting an ACLU lawyer to sue the school district for her, they cancel the prom?

That's like me not wanting people to come to my barbecue who use foul language and being sued by the ACLU for infringing on their right to free speech. I'd just cancel the barbecue.

They canceled the prom after she asked to go with her girlfriend. They said no. She contacted an attorney and they canceled so as not to comply with her request. That is an indirect challenge to her first amendment right to freedom of expression. The fact that they canceled the prom really has no relevance other than the reason they did was keep her from showing up with her girlfriend. That is why the judge did not order the school to hold a prom, as he had no grounds to. However, he did find grounds to hold trial on the fact that she was denied, by a rule, from attending the prom in way that freely expressed herself. All he did was said that it merits a trial. Her attorney still has to prove her case.

This really isn't that hard.

The only dumb ass in this thread is those of you claiming she was denied any rights. There is no prom thus she can not be denied by the school board to attend since it does not EXIST. Even the Judge stated he can not order the school board to hold a Prom, so no case. The school should sue to have their court costs covered by the losers that have in effect brought a frivolous law suit.

She was denied the prom before they canceled it. It wasn't until the ACLU sent the school a letter that they canceled it.
