SCOTUS is reluctant to interfere with the internal working of Congress. Separation of Powers. That's why they overrule the radical 7th Circuit Court when they try to hamstring the president on his powers like being able to prevent anyone from anywhere entering our Country.

Next time, ignore the 9th and do what you are allowed according to the Constitution.
