Jack Smith could be indicted for Fraud for Omitting Trump’s "Peaceful" Statement

Dershowitz told the Megyn Kelly Show podcast on Friday that by his own standard, Smith could be charged with fraud, because of his omission of Trump’s “peaceful” rhetoric.

Never happen. Smith is working for the Democrats and therefore is above any and all rules of law.

Dershowitz is really digging deep into his has on this one and you are right there to wipe it for him. Smith is not surpressing or withholding any exculpatory evidence which would be a crime. Trumps words-all of them are out there for all to see. Only BREITBART would even print this horseshit and only MAGAt morons would repeat it.
 
No. He can't. The only thing that can happen here is that a jury finds Trump not guilty. Or he gets found guilty, appeals, and his conviction is overturned on appeal.
Those are the only choices.
The only way you get a conviction is if they somehow manage to seat a jury with twelve people who have made up their mind that they are going to vote guilty no matter what and stick with it.

I don't know if the Democrats on here really believe that only the prosecution will present evidence, but team Trump will either

a) be allowed to take the time to thoroughly present its case after the prosecution rests, having cross-examined each prosecution witness.

or

b) not be given sufficient opportunity to make a defense and to cross-examine witnesses.

Option a) means acquittal and option b) means overturning of any conviction on appeal.

or

c) see Trump be convicted on something so asinine and meaningless that he just shrugs and continues his re-election campaign.

No one believes anything of the kind. Of course the defence will present evidence although I don't know what that will be, except perhapps insanity. And why would you think that the defence would not be given sufficient time. No Judge wants their case overturned because of their own mistakes or percieved bias.

Trump isn’t being indicted for what he said cm on the Elipse. Trump is being indicted for what he did in terms of the phone calls and pressure to Secretaries of State, Governors, and state election officials in multiple swing states. He was indicted for the fake electors schemes, which he ran in multiple states.

Trump is being indicted from lying to government officials at all levels about the results of the election and trying to overturn the certification of Joe Biden’s election.

Even if they’re really had been election fraud, what Trump did after the election was declared for Joe Biden, was still illegal.

The only legal means to overturn the election is through recounts and court challenges to the results and Trump lost everyone of them. 67 cases before over 90 judges. And he lost those cases because he had no evidence whatsoever to back up any of the claims he made to the court.

If the defense will be given sufficient time, then there is almost no chance that the trial will be over before the election.

Which may be the strategy. Present as much evidence against Trump as they can gin up, and then rest right before election day, giving Trump no chance to defend himself before the voting.

Trump should have been indicted on January 7th, but DOJ did NOTHING towards investigating the coup leaders until after they were shamed into it by the January 6th Committee's work, in 2022. And as soon as DOJ started investigating Trump, he immediately declared his candidacy, and started declaring "election interference", which of course lead Garland to appoint a Special Counsel.

Trump has had 2 years to prepare for this trial, and he knows what he did, and that he's caught. It's unbelievable that you think he needs time to "prepare a defense". If the charges are bogus, and there's no evidence, the charges will be tossed in short order. See both trials that John Durham prosecuted.

No, they are not. That is the purest of ignorance. "speedy trial" is a phrase in the constitution and it applies to defendants, not to politicized prosecutors hoping to queer an election.

That's not how trials work. The prosecution presents its case and the defense rebutts it. Until discovery is complete, the defense has no way to know what kind of a defense it will need. No lawyer would just say "nuh-uh," as a defense.
