No court or judge has the power to arbitrarily make this distinction. It must come from a jury after charges and trial.

Stretching it are you not... The wording of the 14th amendment requires a conviction not a presumption, which you do not have. Secondly, a Judge is not protected when he/she commits a criminal act outside of the law, which this was.

This document from congressional research service says that it doesnt required a conviction.
And as long as a judge is working in an official capacity, the judge has absolute immunity from defamation.
