it's a grand jury, that is asked. The prosecutors presents all the evidence that he has to a grand jury for an indictment of a person they believe broke the law.

the grand jury examines that evidence and testimony they may hear and decides whether the prosecutor has a solid case that the person broke the law.

99.9% of the time, a grand jury agrees with prosecutors once they have presented their evidence of the criminal act committed to them, and the grand jury issues an indictment.... the person is charged with a crime.

They also wrote an amendment process to the constitution, so that we as a country can move forward... as we gained more knowledge and moved ahead with the times. If they thought we would stay with the thinking of the times in the late 1700's then there would have been no amendment process or ability.
