This is why i have a problem with Neocons like McCain and others. You have to read the guy his rights as he is currently a U.S. Citizen. They didn't have a choice on that one. I'm certainly no Hopey Changey cheerleader but they did get this one right. The Courts have ruled that U.S. Citizens cannot be handled as Enemy Combatants anymore. Now it gets more tricky when they are captured on the battlefield. Personally i fully support them being handled as Enemy Combatants and tried in Military Courts. I thought Bush had that one right. However the courts have ruled otherwise. If you're a U.S. Citizen,you are entitled to having your rights read to you. It's the Law.
