That would depend on the laws of the jurisdiction, the circumstances of the crime, and the sentencing guidelines afforded a judge should the defendant be found guilty.


The Supreme Court has held that judges have considerable latitude with regard to enhanced sentencing when race, religion, or national origin are factored into what motivated a defendant to commit a crime, independent of the original charges.


That one wasn't charged with a 'hate crime' doesn't mean his punishment won't reflect the fact that the race of the victim was part of the motive.


The OP should consider researching an issue first before seeking to contrive a controversy where none likely exists solely to advance an errant, subjective, and partisan rightwing agenda.

The investigation is not finished and the prosecutor hasn't made a determination of what crimes the assailants will be charged with.

When it's white on black crime, the media and talking heads immediately start accusing the perpetrator of being a racist and cry hate crime! When it's the other way around, even the police are afraid to use the term.

This is an unmistakable mindset that is present in both the media, the administration and now law enforcement. It's become politically incorrect to call it like you see it.

Even though it's still under investigation, the police are not charging the attackers with a hate crime. They don't even want it mentioned in the media.

In the Ferguson shooting, the media and many on the left merely needed the words of one friend of Brown's to go with a whole story. In cases where minorities are the aggressors, they do their best to minimize the seriousness of the crime.

It's more about the mindset and the way the left approaches this. It's seriously twisted.

Look at the actual coverage of incidents and note the stark difference. That is the real issue here. Media is trying to shape public opinion by exaggerating one incident while minimizing another. Pretty obvious on why it wasn't listed as a hate crime. If it had been reversed and those kids called him a n!gger, then it would be classified as a hate crime.

I believe that hate crime should definitely be charged and the DA should provide evidence to prove the charge. Pardon me if I am a little sceptical of your source's assertion that no hate crime charge will be made along with the other charges.
