Under american english common law a child was the property of of the father. As the women had no right and were property of the male.

I kinda giggle a little when a republican says we need to go back to original intent. 😂😂😂

But anyways.

An animal rights group actually brought up the first child abuse laws because the laws of Animal abuse were stricter than the laws that protected children.


I find that interesting that animals had more right than the children up to 1873.

Kids are not mentioned at all in our constitution until the 14th amendment was passed and ratified. That was left to the states as it was not the purview of the Federal Gov't to legislate such things.

Republicans aren't suggesting we go back to the original constitution minus the BOR and subsequent amendments.

Children's rights laws are almost all state based or began in the states and DC has still to this day done little in the way of legislating them.

Now if a state start legalizing child abuse the feds would step in.

Child abuse laws and laws defining child abuse differ from state to state. What is considered abuse in one state may very well be lawful in another.

If a state legalized public whipping it would violate the constitutional protection against cruel and unusual punishment and we have federal protections when it comes to child porn and child sex trafficking but child protection laws are almost all state laws.
