Again there was no insurrection or law violated in Colorado
Hell simp time for Colorado to take Biden off the ballot

Of course as the basis is the constitution not state law. Section 3 of the 14th Amendment has been used to disqualify a presidential candidate in Colorado and others are scrambling to do the same thing. That cannot be denied.

You state something that is totally irrelevant and quite obvious. They use the wording of the constitution.

Still states are the ones who run the presidential election process in each state.

Why because election processed is decentralized. States that make mistakes can learn from other states who do not have the same problem. That is why decentralization is good.

If it was centralized at the federal level, then someone like Trump would find it easier to cheat and remain in power. He could use his control of the federal government to remain in power. Since he has to deal with states , then it is a little bit harder as the phone call he made to two states show.

Bottom line election law in America is decentralized.

That why elector go to Washington DC to cast the a ballot for a particular candidate who will be selected as President.

It is also why Trump supporters attempted to use fake electors to cast a vote for trump.

It is why Colorado is making this bold move because they believe Trump violated the constitution with his antics.

I think that the Supreme will refuse to hear it as it is a landmine that they do not want to step on.

The appellate court will uphold the CO ruling.

SCOTUS will allow that ruling to stand.

Interesting that you would post it being the job of each states secretary of state to conclude eligibility to run for a particular office on ballot.

As said Jim Crow laws were legal until the 14th and other amendments made them unconstitutional. The country had long denied the vote to blacks, women etc.

But Jim Crow laws were a response to the end of Reconstruction, which occurred AFTER the 14th amendment was passed.

Jim Crow laws were never Constitutional, even if the Plessey Court erred and said they were.
