NASHVILLE, Tenn. -- A Catholic hospital in Colorado has argued in court documents that it is not liable for the deaths of two 7-month-old fetuses because those fetuses are not people.


So far, courts have side with the hospital.


But that defense contradicts church teaching that human life is sacred from the moment of conception. At least one prominent abortion foe called the hospital's claims morally untenable.


The issue of whether a fetus is a person was raised in a lawsuit filed by Jeremy Stodghill, whose 31-year-old wife, Lori, died in 2006 at St. Thomas More Hospital in Canon City, Colo.


Lori Stodghill was 7 months pregnant with twins at the time. The suit claims the hospital failed to perform an emergency cesarean section to save the fetuses.


According to published reports, a brief filed by the hospital, owned by Englewood, Colo.-based Catholic Health Initiatives, said that the fetuses are not covered by state's Wrongful Death Act.


"Under Colorado law, a fetus is not a 'person' and plaintiff's claims for wrongful death must therefore be dismissed," the hospital argued.


A state district court and an appeals court agreed with the hospital. The case, originally filed in 2007, is currently on appeal to the Colorado Supreme Court.

There are other arguments they could make.

It is important to note that embryological evidence shows that the human embryo is a whole, although obviously immature, human being; it is not a mere part. This is a crucial point: human tissues or human cells, whether body cells or gametes, are indeed human—that is, genetically human—but are not whole human organisms. Neither of these has the active disposition to develop itself to the mature stage of a human being. By contrast, the human embryo, from fertilization onward, is fully programmed to actively develop himself or herself to the next mature stage along the path of human development.

No...I just feel that God gave us free will to make our own moral choices. If God gave us free will, who is man to take it away?

And who is God to stand by and let people commit murder? How can we speak of free will when we cannot even give a human fetus (yes human, people) that chance to grow and take part in it? How can we say "we have a right to live" but then kill a developing child in the womb? If a woman is raped, and a child is conceived from it, how would it be fair to take out her anger on a child who had no choice how it was brought into the world?

I don't know....30k gun deaths per year, 10k DUI related deaths....plus stabbing deaths beating deaths, strangulations...that's just here....let's go abroad and count the Deaths in Syria and all the other war torn areas of the globe....seems like God decided to do the judging on his timetable to me.
 
The trial is happening in a state court. It would be inappropriate to say the least to bring in some religious argument in a court of law. What liberals want is to have separate laws. If a party is a Christian than ecumenical laws should apply and not state laws. And. all laws should only be applied against a Christian, never for a Christian.
